My case was filed on july 2 and got rejected due to incorrect fees. I was told, it was mail room error and was refiled on Sep 12th. I was under the impression that all the rejected cases have receipts numbers and the cases are entered in USCIS database.

I called USCIS and my case information is not in database yet. My attorney told me that they only have a reference number for inquiry(yet to explain why no receipt number instead).

Have you guys seen this happening in other cases?

In Section , it was written as "Sec. 203 (b) (3) (A) (i) or (ii) ".

Not able to figure it out.

Yes, you have to file a change of address form.
Also make sure your employer files an LCA for the new location.

My I-140 & I-485 applications had been transferred to VSC for receipting and later my I-485 was transferred back to TSC. But my I-40 has been pending at VSC for close to 6 months with no signs of any processing. VSC seems to be still processing Apr 06 applications while TSC has been processing I-140 under 6 months. Realistically my application should have stayed at TSC, but was transferred to VSC due to receipting delays and balance the workload. But now my application is stuck at VSC. For no fault of mine, my applications ended up in VSC. There is no signs of PP starting anytime soon. Can I lodge a complain to ombudsman in this regard? Will they be able to help me? Who do I contact and where can I find all the information to lodge a complaint?

Any I-485 approvals from Nebraska.. for EB3-I in the month of Jan..
My finger printing was done in Sep-2007 .....took an Infopass and opened a SR .The IO officer @ infopass said that the finger printing has to be initiated from Nabraska...any body on the same boat

You are fine. You can continue to work in US on the approved I-797. In US visa is required only to enter into United States. Once you cross the customs and walk into US that VISA is nothing. There after everything is I-94. with I797 you got new I-94 and that reflects your status.

I got an H1 from an employer with changes of status from L1 effective 31- jan but I will be joining this company only on 4-april-2011. I continued to work for L1 employer till
20-Feb after which i returned to India.
Now i have my visa interview - will i face issues because of the 25 days i spend with L1 employer and that I dont have H1 employer pay stubs?

Hi Immigration Voice Team,

I would like to know your advice,

My details are

- EB3 / Labor filed and approved during July/2007
- I140 & I485 filed concurrently during August/2007
- I140 got approved on Jan/16/2009
- EAD Renewal is made and existing one is valid till Nov/2010

I have only labor number, 140 approval notice with me. where as I do not have labor complete job description.

As of now

- Can I change my employer without any labor job description?
- Does my employer has still rights to revoke I140?
- How can I change job to new employer and protect myself from I140 revoke by existing employer?
- GC filing expenses was completely bared by employer only.

Hi, I am a U.S. Citizen, and my husband is not. I would like to apply for unemployment benefits, but I am worried that it may affect his immigration process. We will soon apply for his green card with the help of a cosponsor. I wanted to make sure that he would not be affected at all by me claiming unemployment benefits. I figure that it wouldn't affect him because of the fact that we will be using a cosponsor, but I didn't want to risk it.
