Dear all,
Myself and my husband both have approved I-797 for H1B from different US companies.
I went for my stamping to US embassy and they asked for more evidence regarding the US company and my case is currently pending with them with all my documents ( passport, I797, marriage certificate, etc).
Now my US company is not able to get a job letter for me.
Meanwhile my husband is planning to go for his stamping. He has good evidence to support his case.
My questions are -
1.) How can I retrieve all my documents from US embassy without affecting my passport and my H1 case?
2.) If I am able to retrieve all the documents safely, can I apply for H4 with my husband`s H1 stamping?
3.) Will they create problem for issuing H4 to me because of my pending H1b case?
4.) With H4 visa and I-797 approval notice, can I start working in US ?
5.) What will be the best way out of this situation without affecting our working visas ?

Please reply if you know anything.

Hi,

I had applied for GC through my husband s employer for EB1 category. Recently USCIS websites has updated on its site regarding our case that I485 has been approved but I765 has been denied. Currently we are on L1/L2 visa. Has anyone faced such a situation? And what does this signify?

Can anyone pls shed light on this.

Mercury News ran an article today about H1-B Visas and mentioned that "Rep. John Shadegg, a Republican from Arizona, [was] planning to introduce a bill this week or next that would nearly double the number of H-1B visas".

Does anyone know anything about it and does it include EB provisions, as well?

We filed two different I485s. One me as Primary, for which I have not received any receipt which reached on July 17th. Another from my husbands employer, me as beneficiary which reached on Aug 13th. We got receipt and FP Notice for one which was applied through my husband's employer. Confusion is that in my receipt notice the Alien Number is different from what I received on my I140 Approval Notice. Is it of any concern? Finally will my husband be able to get EAD from my application?

Appreciate any views or opinions!

No. Wife's status change is independent of husband. H1 status of husband is not invalidated by wife's use of EAD.

I was reading some info abt EAD on this site and have come to know that Once H4 visa holders get their EAD's can work after getting SSN.But I read that If H4 visa holders start working as soon as they got EAD's.Does this invalidate H1 visa status if wife starts working on EAD.Please clarify my doubt.

Hello out there. I have a question regarding co-sponsors for international fiance visas. My Dutch boyfriend are looking to marry after 3 years going the Fiance Visa route. I know the financial requirements I need to meet is $18, 212 for the both of us. I do make that, however, I haven't filed my taxes in years and I'm an independant contractor (whole other story). I live in New York, my mother lives in California and is willing to be a co-sponsor; she's retired, makes more than enough in her pension, social security and about $150K in savings. My question is, since she will be the co-sponsor and of course she'd need to fill out the I-134 (Affidavit of Support)--do I ALSO need to fill out the I-134 too?...or just her alone? Please help....Thanks all!!! Also what paperwork do they require?...Last 2 years of current tax returns? Thanks again!

Hello,

I am on a H1B with company A. I've been offered a job with company B which is currently processing my H1 transfer paperwork. I had accepted the offer letter from company B and had submitted all my papers for H1B transfer.

The starting date in the company B is 20th Nov as per offer letter. Now I had decided to stay back with the company A (by 18th Nov) before joining the company B. Is there any issue by doing so?

Hello all,
Can someone guide me which category i am eligible to file my Labor with current employer?

As of today, i have bachelors + 6 yrs of experience. But when i joined my current employer, i had 4 years of exp.

1. Am i eligible for EB2 category with Current employer?
2. Or do i need to change current employer and file my GC?

If you have receipt # you can check the status on uscis.gov, you can also call their 1-800 # to check what's going on with this application.
