Hi !
I have I-140 approved with PD of Aug-2007. I-485 is not yet applied. My 6 years on H1b are over. I got 3 more years of extension till 2011 on H1B based on I-140. I have also got the extended H1b (till 2011) stamped on my passport. Now I am looking to change my company before lay offs happen.
What are my options :
1. Can the new company transfer my H1B and I-140 ?
2. If they can just transfer my H1B, what happens to my PD of I-140 ? And what I may need to provide or tell the new company in case of transfer ?
3. How many years of maximum extension should I expect from the new company on H1B ?
4. Do the new company has to start GC processing ASAP ?

You can't leave the country while your AP is pending unless you have a valid (unexpired) H/L or any other visa that you could use to enter the country.

I have filed a 485 since i married a citizen. I have had my interview with the immigration officer, since my application is 2 years old (do to the excesive moving ive done) she asks me for another medical and a co-sponsor. Medical is no problem, but i cannot produce a co-sponsor. i need a co-sponsor because my wife has 5 kids from a previous marriage, and the household income does not meet that of the guidelines. We do not have any relatives or friends that can help. I have to submit this information by Jan 21 2009.
What are my alternatives?

I am working for a client which gave me an offer for a respectable amount. it is much higher than the amount specified in ETA 9089 (F/5) column. my Onet code for the original labor is 15-1071.00. my new job is defined as System Specialist. my job functions( roles) are pretty much the same as my original labor certificate. I tried to search the Onet Code for System specialist and did not find a good match.
Can any one suggest me what are the options.
I also wanted to know weather USCIS will send any letter to new employer regarding to the offer extended to me. MY situation is the client is not willing to sponsor me.

I recently received my Greencard. Will be getting married in a few months and wanted to find out the options available to sponsor my fiance. Fiance is a british citizen, does that help in any way? Also she is a qualified Doctor in the UK and is planning on taking USMLE part 1 & 2 prior to the wedding. Is it prudent to have her move to the US on an H1B instead?

Category classification of EB2 or EB3 is done when filing I-140. Labor does not have any such classification. It all depends on the job requirement that decides EB2/EB3 at I-140 while filing.

I am working with a big company (company A) as a full time employee. My GC was filed under EB3. Priority Date is June 2004. Through another consulting company(company B), we started another GC process under EB2. Its priority date is March 2005. Based on what I read on various forums, it is possible to do interfiling from EB3 to EB2 and port priority date from EB3 to EB2. Is it true? We did not recapture the priority date when 140 for EB2 was filed. 140 for EB2 was approved under March 2005 priority date. I have EAD from employer A. Can I join employer B using that EAD and interfile from EB3 to EB2? Or is H1 transfer a safer option?

Hi,
I'm in the process of going through the naturalization process having filed the N-400 form.
However, I have a change of plans and would like to 'abandon' my naturalization application.
Would this affect any of my future applications? be it a future naturalization application or petition for a relative the green card.
Thanks for any advice as I can't seem to get a definite answer.

Hi,
I m without an assignment for about 3 months, but I m maintaining my status bcoz the employer is running the payroll with minimum salary. mean while i m expecting a full time offer from a company and they are willing to transfer the visa. so my question is that when the new company will be asking for the paystubs for the transfer, I have the paystubs which have a reduced(minimum) salary than what I was earning when I had a project, so will it affect my job offer or any questions will be asked by USCIS?
i know the questions are pretty open, I would appreciate any replies/advice on this,
