Hi All,
Me and my wife are traveling to India. We are going for visa re-stamping (consular processing).
Based on the information provided below, can you provide lists of forms/docs that we're supposed to carry with us when we visit the consulate for stamping?

My visa:
- I entered on H1B. Then I had to change employer so visa was transfered (And they extended it for another 2.5years). So now I have a H1B visa which is valid till June 2009, and passport with expired H1B stamp.
- With the new employer - I've an approved PERM. I140 is pending. I485 is filed. EAD received. Do I need to take approval notices and/or receipt notices of any/all of these stages?
My Wife's visa:
- she entered on H4. Now she has a H1B visa which is valid up 2010, and passport with expired H4 stamp.
Is she required to take approval notices and/or receipt notices of i485.. or my PERM or i140?
I would say just have all the receipt notices handy. They are not required and they didn't ask me for it when I got my visa restamped but you could carry a copy on the day of interview just to play it safe.

Just wondering how many souls are out there in the country with EB-2 India PD of 2004 and earlier but are not here on IV.
Even with a 1% representation ( assuming that 2004 folks such as us are NOT tired to participate in poll), the total number should be some thing like 8000-9000. 1.5 dependents makes it 20K-25Knumbers.
Also I noticed that a lot of people who voted here has their profile listed as EB-3. Did those guys took the wrong poll or did interfiling?
I feel that OCT EB-2 I & C reversal of DOS was a knee jerk reaction to USCIS's random approvals and we should see a good jump's in next few months.

Actually, I don't think there really is a ROW is there? Isn't it just that 193 country columns isn't practical.
actually as and when a country hits the 7% per-country limit or in general becomes a big consumer of visas, it gets its own column.
China for instance has been in and out. In 1999 it was its own column, became part of ROW in 2002 and now again has its own column:

If H1/ H4 is still valid, you can revalidate H1/H4 if you leave the country, get a new visa and re-enter. S/he needs to do that no later than 180 days after I-485 denial. S/he is out of status starting from the denial of I-485.

sparky_jones: can you give us your write up to USCIS regarding this missing field information. What was in the letter regarding this field. I plan on sending a letter to them providing this information.

Receipt # ***-**-****"
Below that, I simply put the following statement:
"Please update Item 12 �Date of Last Entry into the US� for Form I-765 to **/**/****. This field was omitted during the e-Filing process."

Hello All,
Employer A filed my I-140 and it was approved. They refused to provide me the approval notice but provided me the receipt#.
Later I moved to company B. Now company B is starting my green card process.
They said I can port my priority date If I have the I-140 approval notice.
My questions are
1) Is it possible to request USCIS a duplicate copy of my I-140 approval notice
using either g-639 (FOIA) or I-824 (Action on an approved application or petition) or any other method as I have my receipt#?
2) I don't know whether or not employer A revoked my I-140. Can I used it
to port priority date even if my I-140 is revoked?

Two bills tackling this matter have recently been introduced. One is the Protect America's Competitive Edge Act, by Senators Pete V. Domenici, Republican of New Mexico; Jeff Bingaman, Democrat of New Mexico; Lamar Alexander, Republican of Tennessee; and Barbara A. Mikulski, Democrat of Maryland. This is very promising news. We knew about PACE but another similar bill by Senator Joseph I. Lieberman just adds to the excitement. We should keep a close eye on these bills and maybe start sending communications to the lawmakers about these bills.

Actually, I was trying to avoid kanhaiya's comments....as we say in our country, barking does does not affect the walking elephant.

It's family-based, so I believe the 245(k) act doesn't apply to me. Then again, I didn't really work because buying/selling online takes a few clicks.
If it is through your Spouse then do not have to worry? What was period of this of this work? If it is only this year some CPA can do magic

I just came back from bombay. I did not have an AP. I went to the consulate for stamping. If you are maintaining valid h1b status and have a stamp, there is no issue at all. Just carry your I-485 receipt with you and make sure you mention it at POE.

Even with a B visa you cannot work without permision from DHS.
